LEGAL FIELDS

FlexiLEX advisors have gained decades of experience in various specialist fields, but whatever our individual paths, we have all learned to cultivate the essential balance between focusing on our speciality and working with each Client’s big picture, their overall legal and business needs.

Our area experts provide quality advice in

sales contracts, distribution contracts, rental contracts, agency & brokerage contracts, joint ventures, digital signature

exclusive distribution contracts & networks, selective distribution contracts & networks, franchising contracts & networks, agency & brokerage contracts, drop shipping contracts, stand contracts

Some doubted this field even existed until we had the vision to write the first coherent analysis of the topic, and then publish the first website and journal dedicated exclusively to its study in 2009. Few are as well placed as our experts to provide you with imaginative, flexible, and quality solutions to your international distribution needs.

Originating thousands of years ago in sports game rules that applied beyond the field of play (e.g. Mesoamerican ballgames), sports law has become one of the fastest-growing legal fields. The internationalization of modern sports has transformed the business of sport (including manufacturing, competitions, and media) into a multi-billion pound industry. This growth has contributed to making sports law a surprisingly complex field, including the fact that it

  • is a mosaic of many other fields, including contract law, employment law, association law, arbitration law, commercial law, and intellectual property law
  • applies to several types of individuals (athletes, agents, officials, etc.) and entities (clubs, companies, federations, etc.)
  • applies at local, national, and international levels, with some rules being harmonized (for example by international federations) but others contradicting each other (such as case law)
  • regulates both private and public spheres of athletic activity, and thus combines regulatory frameworks (public law) with contractual ones (private law)
  • places particular emphasis on arbitration and other alternative methods of dispute resolution instead of standard litigation, thus leading to two very different paths to settlement.

In parallel to its complexity, sports law is a particularly challenging field in practice because it is very fast-paced (there is no “off time” during seasons) and requires extreme flexibility to adapt to last-minute changes (especially around competitions and transfer periods). The love and business of sport also bring together people from very different backgrounds and work cultures.

FlexiLEX counsel have years of experience in successfully navigating these challenges, and advising Clients in complex sports law and sports business law matters, including those relating to:

athlete contracts, athlete intellectual property, athlete personality rights (including image, voice, likeness, name), athlete transfers, agents, agency contracts, sports clubs & associations, leagues, national & international federations, sports governance, statute & by-law drafting, sports discipline, sports integrity, sponsorship, competitions, prizes, dispute resolution

data protection & privacy regulations (including GDPR), digital copyright, software licensing, online & email marketing regulation, domain name disputes, software patents, database intellectual property rights, website terms, online sales contracts & regulation, digital signature

mediation, e-discovery, business evidence, judicial procedure, arbitration agreements & clauses, choice of law clauses, arbitral rules & process (including ICC, LCIA, CAS), injunctive process
